After Kalkaska County Prosecutor Brian Donnelly's sudden death on Jan. 14 left a large vacancy in the county's judicial branch, 46th Circuit Court judges raced to appoint a new prosecutor.

Serving under Donnelly as chief assistant prosecutor, Kirk Metzger was appointed into the role of interim county prosecutor Monday, effective immediately.

Metzger agreed to accept the appointment and thereby sworn in by Circuit Court Chief Judge Janet Allen.

"(Metzger) advised that he would not seek election to the position in November," Allen read from a prepared statement. "To promote continuity and productiveness, he has agreed to be a placeholder in the office for as long as professional and personal circumstances permit him to do so or until the election in November."

If Metzger leaves office prior to November, the court will solicit applications from interested and qualified applicants to fill the position until the November election.

"With Mr. Metzger willing to accept the appointment, the court feels that the citizens of Kalkaska County should be the ones to select the next prosecutor," Allen said.

Judge Dennis Murphy and Allen were the deciding party in the appointment process, ultimately selecting Donnelly's assistant.

"I can see a lot of Brian in him," said Kalkaska County Sheriff Dave Israel. "He's a good trial lawyer.
